_Terms of Service

1. About GigOnUp

GigOnUp (“we”, “us”, “the platform”) is a talent marketplace that connects event planners (“Clients”) with professional musicians and performers (“Talent”). We facilitate introductions and payments; we are not a party to any performance contract between a Client and a Talent.

2. Eligibility

You must be at least 18 years old and legally permitted to enter into contracts in your jurisdiction to create an account or transact on GigOnUp. By using the platform you represent that these conditions are met.

3. Accounts

  • You are responsible for maintaining the security of your account credentials. Notify us immediately at support@gigonup.com if you suspect unauthorised access.
  • You may not share accounts or create accounts on behalf of others without their explicit consent.
  • We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or cause harm to other users.

4. Talent Vetting

All Talent accounts are reviewed by our team before appearing on the marketplace. Approval is at our sole discretion. Approved status may be revoked at any time if a Talent breaches these terms or receives repeated negative reviews.

5. Payments & Platform Fee

  • All payments are processed by Stripe. By making or receiving a payment you also agree to Stripe’s Terms of Service.
  • Clients pay a 5% service fee on top of the agreed booking price at checkout. GigOnUp also retains a 10% platform fee from the talent payout. Both fees are non-refundable except where GigOnUp is at fault.
  • Payment is collected in full at the time of booking confirmation (after the Talent approves the request). The full amount is held in escrow by GigOnUp and is not accessible to the Talent until release.
  • Funds are released to the Talent within 3 days of the event date. The Client may release payment early at any time after the event by visiting their booking page. Release is blocked if there is an open dispute on the booking.
  • Talent receive payouts via Stripe Connect. By onboarding as Talent you agree to the Stripe Connected Account Agreement.

6. Cancellation & Refund Policy

The following policy applies once a booking has been paid in full (booking status CONFIRMED or later). Requests before payment carry no financial obligation.

  • Platform fees (the 5% client service fee and 10% talent fee) are non-refundable in all cases.
  • Refund requests must be submitted via support@gigonup.com with your booking ID. Refunds are processed within 5–10 business days and are subject to Stripe’s processing timeline.
  • In the event of a genuine emergency (medical, bereavement, natural disaster), GigOnUp may at its sole discretion waive these terms upon receipt of supporting documentation.

7. Disputes

If either party believes the other has materially breached an agreement (e.g. talent did not perform, client failed to provide agreed conditions), they should contact support@gigonup.com with their booking ID within 3 days of the scheduled event date, before the automatic escrow release. GigOnUp will review evidence from both parties and issue a binding decision within 5 business days. Talent payouts are held for the duration of an open dispute.

8. Prohibited Conduct

  • Circumventing the platform to arrange or pay for bookings outside of GigOnUp is strictly prohibited and may result in account termination.
  • Providing false information, impersonating others, or submitting fraudulent reviews is prohibited.
  • Harassment, discrimination, or abusive conduct toward other users will result in immediate suspension.

9. Intellectual Property

Content you upload (photos, videos, audio) remains yours. You grant GigOnUp a non-exclusive, royalty-free licence to display it on the platform for the purpose of marketing your profile. We will not sell your content to third parties.

10. Reviews & Ratings

  • After a booking reaches COMPLETED status, both the Client and the Talent may leave a star rating (1–5) and optional written review for the other party.
  • Client reviews of Talent are displayed publicly on the Talent’s profile page and contribute to their overall rating visible in search.
  • Talent reviews of Clients are not displayed publicly. They are visible only to verified Talent on the platform and are used to help Talent make informed decisions about booking requests.
  • One review per booking per party is permitted. Reviews cannot be edited after submission.
  • Users may request access to any review data held about them in accordance with applicable privacy law by contacting support@gigonup.com.
  • GigOnUp reserves the right to remove reviews that contain false statements of fact, personal contact information, or content that otherwise violates these terms. Submitting a fraudulent or retaliatory review may result in account suspension.

11. Limitation of Liability

GigOnUp is not liable for the quality, safety, legality, or any other aspect of the services provided by Talent. Our total liability to you for any claim arising out of or relating to these terms shall not exceed the platform fees paid by you in the 12 months preceding the claim. We exclude all implied warranties to the fullest extent permitted by law.

12. Governing Law

These terms are governed by the laws of the jurisdiction in which GigOnUp is incorporated, without regard to conflict-of-law principles. Any disputes shall be resolved by binding arbitration before resorting to litigation, except where prohibited by law.

13. Changes to These Terms

We may update these terms from time to time. We will notify users of material changes via email or an in-app banner. Continued use of the platform after the effective date constitutes acceptance of the revised terms.
